HOUSING ACCOUNTABILITY ACT (HAA) NOTICE
Formal Housing Development Project Application Nos. PLAN-MIN-2025-00016 and -00017 (filed on November 25, 2025)
Housing Accountability Act Notice Pursuant to Government Code Section 65589.5(h)(6)(D): Housing Development Project Application for the Property located at 7373 Henness Ridge Rd and 7401 Coke Cherry Lane, Yosemite West, California 95389, known as Assessor’s Parcel Numbers 006-070-009 and 006-100-013:
- Formal Housing Development Project Application Nos. PLAN-MIN-2025-00016 and -00017 for the development of 110 factory-built modular residential units with 20% of the units reserved for low-income housing and 120 parking spaces. PLAN-MIN-2025-00016 proposes one-story residential units, approximately 12 ft in height, while PLAN-MIN-2025-00017 proposes for 95 out of the 110 total residential units to be 2-story structures, approximately 24 ft. in height.
The applicant for the above-referenced Project submitted a written notice to Mariposa County (“County”) pursuant to California Government Code Section 65589.5(h)(6)(D). California Government Code Section 65589.5(h)(6)(D)(ii) requires that if an applicant provides a written notice regarding a local agency's course of conduct on a housing development project application, the local agency is required to publicly post that notice on its website and provide copies to specified individuals and to the county clerk.
On December 29, 2025, the Applicant for the above-referenced Project sent the attached regarding the “Final Letter for Pre-Application Nos. PLAN-MIN-2025-00011 and -00012 and Incomplete Response Letter to Pre-Application Nos. PLAN-MIN-2025-00016 and -00017” dated December 19, 2025, requesting that Mariposa County “confirm that all of the items [in the letter] are withdrawn and that the County will comply with the Housing Crisis Act, Housing Accountability Act, and Permit Streamlining Act and deem our SB330 applications complete. Otherwise, please consider this an invocation of Government Code Section 65589.5(h)(6)(D)...”
The preliminary applications (PLAN-MIN-2025-00011 and -00012) were deemed complete on September 8, 2025. The County received the Formal Applications on November 25, 2025, (PLAN-MIN-2025-00016 and -00017) and the County is continuing to process these Formal Applications to comply with the California Environmental Quality Act (Division 13 (commencing with Section 21000) of the Public Resources Code) (“CEQA”). In addition to requiring information from the Applicant to enable Mariposa County to comply with CEQA, the County has also requested information from the Applicant necessary to comply with the County’s own ordinances, policies, and standards adopted and in effect on September 8, 2025, when the Preliminary Application(s) were deemed complete. Mariposa County does not agree with the allegations in the Applicant’s letter but is acting in conformance with Applicant’s request to proceed under Government Code Section 65589.5(h)(6)(D). Any objections, comments, evidence, or concerns regarding the Preliminary and Formal Project Applications or the applicant’s written notices, may be submitted in writing to the Mariposa County Planning Department at planningdept@mariposacounty.gov, mailed to PO Box 2039, Mariposa, CA 95338, or delivered in-person at the Planning Department counter at 5100 Bullion St, Mariposa, CA 95338, no later than March 5, 2026.
