Can Homeowners Shoot Intruders?

Fresno Police detectives are still investigating what they’re calling a home invasion shooting that resulted in a death.
The resident said he shot the victim because he walked into his home, sat on the couch and began talking crazy
Police detectives are still investigating the shooting but the Assistant District Attorney and Fresno County Sheriff say if you own a gun, you must follow the California gun law.
"The penal code says you can use deadly force if you’re actually and reasonably afraid that you are gonna be killed yourself," Steve Wright said
Something the resident at Stonegate Apartments will have to prove after shooting an intruder and killing him Thursday afternoon. Charges have not been filed against him but an investigation is ongoing to determine if there was reasonable fear of dying.
As Fresno Police try to determine if the man acted in self defense. Sheriff Margaret Mims says any time you shoot someone you must be ready to explain why and meet the criteria for self defense.
"You felt you were in danger yourself or somebody else, that threat was eminent and you needed to use deadly force to respond," Sheriff Mims said.
And if you take on the responsibility of owning a firearm you must think about the consequences both legal and psychological.
"There really is no one answer, there’s no black or white answer. All the facts and circumstances of the case we have to look at," Wright said.
Law enforcement encourages any gun owner to take classes and learn about the California gun law and potential consequences. Several firearm stores offer those classes.
"Info is detailed in regards of self defense, protocol of how to handle threats and deal with them, know all the laws regarding that. The use of the firearms with actual firearms training," John Lewis said.
